The Importance of Ethics Committees

Health care institutions operate to uphold the rights and well-being of patients. In practicing patient care, members of health care organizations face actions and decisions that should be aligned with ethical issues maintained by health care facilities, such as hospitals, to look after the best interests of patients. To oversee the ethical issues that health care facilities should observe consistently, establishing ethics committees is necessary.In order to determine the importance of ethics committees in the field of health care and medicine, it is relevant to go over the history of the establishment of ethics committees, the varied and significant roles played by ethics committees in health care and medicine, the principles upheld by ethics committees, and the magnitude of ethics committees in health care facilities and the field of medicine. Ethical issues frame health care and the field of medicine.Health care ethics is primarily based on principled obligations that health care and medicine should provide for human beings, as well as the binding obligations to constitutional laws. Health care ethics ensure that health care policies, services, programs, and practices are in line with moral obligations to human beings and political obligations to the state, while keeping in mind the sole purpose of health care and medicine – to improve the quality of life.With the unending and increasing issues and choices that members of health care organizations and the field of medicine must face and decide on each day, there is a need to put up ethical standards and norms to abide by to avoid inconsistencies, conflicts, and disagreements. The requirement for ethics committees was formalized in 1992 by the Joint Commission (O’Reilly, 2008). Ethics committees are composed of various members of health care institutions. Members of ethics committees include â€Å"physicians, nurses, psychologists, lawyers, administrators and supervisors, families, and the comm unity† (Fremgen, 2005).Ethics committees are in charge of overseeing practices and operations within health care facilities regarding the services provided for patient care. Primarily, ethics committees in contributing or improving health care policies employed by facilities by thorough analysis and research and the formulation of ethical procedures or guidelines that the health care facility and all its members must observe at all times. These procedures or guidelines are patient-centered – one which puts forth the best interest of the patient.Ethics committees uphold ethical health care principles and practices by intervening in conflicts within the health care facility, especially when it comes to decision-making and ethical issues. The ethics committee reexamines a particular situation and arrives at a counsel or a suggestion as to how the parties involved will go about solving the problem. The result of the ethics committee’s reexamination is based on ethica l laws and principles endorsed by the state and the health care facility to put the patient’s concerns above all.In some instances, the ethics committee also reviews the quality and kind of health care services received by the patient in order to determine whether it was based on guiding ethical principles or not. (Fremgen, 2005) Ethics committees are influential in determining the fairness, reliability, morality, and integrity of health care facilities. It serves as a quality control committee, keeping health care services, practices, and operations in check, in order to make sure that they comply with ethical principles related to health care and medicine.Through ethics committees, health care facilities are able to sustain a mission, vision, goals, and objectives that are within the limits of what is ethical for health care facilities to provide. This ensures that the quality of health care services provided to patients meet their needs, demands, and expectations and it de fends what is morally upright in relation to patient care. Ethics committees keep professionalism in the work place in check, and it guides major ethical choices and decisions in the field of health care and medicine.With the realization of the significant roles and responsibilities that ethics committees carry out, it is therefore of great importance to health care facilities or organizations to establish an ethics committee that will serve as a consultant or a guide in putting health care practices and operations in line with ethical laws and principles. It does not only add value or integrity to health care facilities, but it also ensures that patient care is provided for, qualitatively and ethically.

Government Enforced Cyber Security, a Public Good? Essay

We all know that cyber security is something of great importance to anyone trying to protect their network assets, customer assets, and personal assets. The list of possible risks associated with neglecting to practice good cyber security are endless, and the dangers lurking out in cyber space too numerous to imagine anyone who is controlling any type of company network to ignore; but the question here is whether or not the government should become the cyber security enforcer not only within in its own government sector but also within the private sector as well as a public good. Before we get into the discussion of whether or not the government should play this role, I believe we should have a short discussion on what â€Å"public good† actually means. Generally speaking â€Å"public good† is a loose term used to justify some kind of action one is taking, by saying that it is in the best interest of the general population to do so. The implications behind the use of the term â€Å"public good† is that #1 the action is beneficial to a majority of the population; and #2 that the majority of the population is either too ignorant, or incapable for some reason of performing the action for themselves. The use of the term is also handy because it is non-specific as to WHO is actually benefiting from the actions; is it the general consumer, the small businesses, big businesses, the government, a special interest group, all of the above, none of the above, Who? Who is actually benefiting from the act? By using the term the â€Å"public good† one does not have to account for who is actually benefiting. Nor do they have to identify who might be harmed or negatively affected by the action either. Additionally by using the term that it is for the â€Å"public good†, by default the concept of how much will it cost, and who is going to pay for it, is seemingly automatically a non-concern. So by the very nature of the term for â€Å"the public good† the user of said term has attempted to write themselves a blank check, quantifying and justifying any and all actions they mean to implement and enforce. The term â€Å"public good† has been used by various entities throughout history to accomplish some of the most horrendous crimes against their people, and to extort unimaginable amounts of wealth and goods from their populations. Anytime the term â€Å"public good† is used to ask for justification for an action from any entity it should be immediately critically examined with a very find tooth comb to find what the motivations for such a kind gesture might be, as well as analyzed by a staunch accountant to find out where the money is, and where it leads in the proposition. The term â€Å"public good† more than any other term I can think of, is more often than not the very term used to lead more sheep to their own quiet slaughter then any war cr y ever has. It should always be approached with skeptism and caution when used, especially in conjunction with the word government. Is Enforcement of Cyber Security a Public Good? Should the enforcement of cyber security be considered a â€Å"public good†? This is a very difficult question to answer. In theory, on the surface, enforcement of cyber security seems like it might be a very viable public service. As viable as other protections offered as a public good such as the services of military and police protections. But then you begin to look a little deeper into the subject and you realize that enforcement of cyber security protections has many more layers then the enforcement of physical protections such as military and police. In order to enforce cyber security an entity would have to do much more than simply provide, train, and fund forces to patrol the physical areas that are in danger. Enforcing cyber security is much more akin to forcing a draft of military service on the general population and forcing them to pay for their own room, board, training and service expenses while they are in the military to boot. In order to enforce cyber security you must force each person who has any interaction with the cyber world, into becoming a cyber security guard, whether they wish to be one or not. Additionally you force any entity whether it’s a multi-billion dollar corporation, a single person running a business out of their basement, or a member of the general population at large trying to access the internet, into funding not only the physical equipment and software required to be a good cyber security guard, but the endless training and education expenses associated with it as well. It would be like an entity not only suggesting that people should have locks on their doors, but enforcing it with requirements for double steel enforced 12 inch wide doors with a minimum 3 locks on it. One of which had to be specialty ciphers lock, and penalizing those that do not have said door, by taking away their entire house. This â€Å"public good† if done the way it would be required to be done to actually be minimally effective, has now become a universal burden just like taxes, who’s only community quality would be the unified contempt the â€Å"public† would have for its enforcing entity and enforcement policies; very much like the contempt the general public has for the IRS. This all being said, I think it safe to say that calling the mandatory enforcement of cyber security a â€Å"public good† is about as accurate as calling the mandatory taxes we pay a â€Å"public good†. Most people when left to speak of their own analysis as to whether or not taxes are really something that is good for the majority of the public would tend to beg to differ. Should government enforce cyber security in the private sector? The government of the United States has many roles. Some of these are roles it was intended to have by the Founding Fathers, as written into the Constitution, and most others were assumed, inherited, given, or seized by some means still unknown to me. One of the proper roles of the government is to provide protection to its citizens by the creation and enforcement of laws that protect the people, ie..Murder is a crime punishable by death; and the creation of protection entities/forces such as police, fire, and military, to physically patrol the areas our citizens inhabit to protect the lives, and property that they own, which is inclusive of the land they occupy as a nation. These concepts were pretty cut and dry, although our congress still found a way to somehow muddy them; but until recently with the invention of the internet and cyber space it was pretty easy to tell where the borders of our nation ended and another’s began, and what constituted a criminal action against a nother person’s being or property. At least the common man could tell these things, lawyers, judges and politicians can be excluded from that statement. In cyberspace, there are no boundaries. The line of what to protect and what is outside the realm of required government protection is very gray. Therefore the government up until now has restricted its enforcement of cyber security to its own government networks. This level of protection is the proper responsibility of the government, because it is protecting its networks in the interest of national security. The department responsible for the protection of its citizens as well as national security is the Department of Defense. The past 15 years with the explosion of Information Systems the DOD has found that its workload and responsibilities have increased dramatically with the government use of Information Technology systems. In the past 5 years alone the cyber security workload on the DOD has more than doubled. Although the U.S. DOD is probably the most secure and efficient government entity in the world, it is far from ideal on levels of security, and it lacks the manpower and r esources to keep up with its own demands of cyber security implementations. I have worked in the DOD for over 10 years now, and can tell you first hand that security incidences occur daily, and the security risks to our government networks is a constant ebb and flow of action/reaction. Rarely does the department get a chance, have the time, or the resources to be pro-active instead of re-active. Ultimately as well, with the very best security technologies in place, even the government must remain dependant on the human elements to protect the networks, and information. The Wiki-Leaks internet postings are a perfect example of that dependency gone badly. It may or may not have been a technical mis-security that allowed that government employee access to all that sensitive data, but it was ultimately several human failures that allowed for that information to be posted on the internet. The failure of the trusted government employee to keep the information he was entrusted with secret, and the failure of how many internet web site owners to work at protecting sensitive national data of the country some of them were actual citizens of. The idea that the current DOD could even enforce cyber security in the private sector is not only laughable, but also an extremely menacing and terrifying concept. The government enforcement of cyber security in the private sector, â€Å"for the public good† of course†¦would be nothing more than a ruse to cover its real aim; which would be regulation of the internet, or to put it bluntly the control of the last totally unregulated vestige of free speech. Besides the obvious issue of lack of integrity behind its intentions there are numerous reasons why the U.S. Government should stay out of the business of regulating the enforcement of cyber security in the private sector. The government, as stated above does not actually have the time, or the resources to manage or enforce any other security implementations outside of itself. †¢ The government already spends most of its time in reactive mode on the security frontier; trying to find additional time to analyze or validate the security set ups of private sector companies as well would be near impossible. †¢ The government does not have the money. Funding for such things as IT equipment hardware and software upgrades is already spread extremely thin. Many times government offices and system are running on hardware and software that are years behind the current releases due to replacement funding issues. †¢ The government lacks the technical expertise in its ranks to be able to support or even audit / validate the security implementations in private businesses. Over 80% of the technical workforce working on government systems are contract workers, hired in because of the lack of security/tec hnical expertise in the government employee workforce. The government does not have within its scope the right to enforce cyber security implementation within the private sector. †¢ The government scope as outlined by the constitution is to protect its citizens against foreign attack on its own sovereign soil, as well as to protect its citizens from physical attacks and destruction of their private property within the boundaries of its nation. There are no boundaries to cyber space; therefore when a citizen of the U.S. chooses to enter into the boundary less area known as cyberspace, they are choosing to inhabit an area that is outside the scope of their countries ability to protect them. They do this at their own risk. If these same citizens left the safety of the U.S. and put themselves willingly into the middle of Egypt right now, they are taking their chances full well knowing that they are willingly giving up the safety and protection of the U.S. If they are taken captive, the U.S. will attempt to negotiate for their release, but it cannot, and will not guarantee it. If it can secure their release or do anything at all for them, it will, but many ti mes it can do nothing so far outside its jurisdiction; just ask Nicholas Berger, the American beheaded in Iraq several years ago. †¢ The government’s responsibility to provide protections to its citizens is a provision of protections that are within reason. Although the government provides police, fire, medical and military services to their citizens; I for one do not have my own personal police officer, or doctor escorting and to attend to me in case I should run into a mugger on the street or get a sniffle in the middle of the night. The services provided are broad, sweeping, and for the use of the general population to both reduce and deter its own population from being criminals as well as to protect and serve its own population. Cyberspace is not its own population. †¢ The government was never given authority to regulate business, in any way, shape, or form; not for the â€Å"public good† or for its own expansion. Not in the name of protections for its people, and not with its intent to create legal monopolies, or cater to interest groups. Regulation of any business interests, including the enforcement of cyber security on business networks is outside of what the government is supposed to doing, and a conflict of interest to the type of government that was originally established for the country which was a democracy. The government does not have the flexibility to efficiently enforce, and manage the cyber Security regulations and compliancy of the private sector, and in trying to do so, would only hinder the progress of the cyber security technologies industries, and protections implemented by the private sector. †¢ Cyber Security is a MOVING target. The government is a lethargic beast. Government bureaucracy consumes easily 60% of all the time, money and resources spent by the government. Time being the biggest issue on this point. Cyber security in order to be the most effective has to be able to be tweaked, re-configured, and updated as fast as your average cyber criminal can re-invent ways to penetrate. The higher value the data is that you work with as a company, the quicker and more flexible you must be to maintain a secure network status. An individual with little valuable data on their system does not need to be all that concerned with the security posture of their system. Not all systems, businesses, and networks can be considered the same, and each ones security posture is going to be based on the value of what they are trying to protect. All cannot and should not be regulated the same. †¢ Creating any type of tiered regulation for cyber security enforcement will add layer s of bureaucracy and therefore delays in actual implementation. Once again being counterproductive to the enforcement in the first place. Who is going to pay for the government to take on this further endeavor? I don’t know about you but I pay enough in taxes for useless programs, counterproductive government measures, misrepresented & abused government powers, and generally overall government meddling in the private sector, both businesses and personal. Even if they charge the businesses for their â€Å"services† the cost will ultimately end up on the general population. This is where the cost always ends up; and this will be no exception. What is the point of the government enforcing cyber security regulating the portion of the internet that runs through the U.S. internet gateways and DNS servers, when it has absolutely no control, or jurisdiction to control anything outside of it. All you would be doing is creating a black market for â€Å"foreign† internet feeds; creating yet another flourishing criminal market. Does â€Å"prohibition† – the very act that gave the organized mob their greatest power and fastest wealth windfall, or the more modern â€Å"war on drugs† that is only serving to create some of the most vicious cartel wars seen, why†¦ because the attempt to regulate and control it only serves to make it an even more profitable illegal industry. Shouldn’t the government stay focused on where it should be focused? Especially since IT has the largest network, with the most valuable and sensitive data in the country on it. Protection of this data actually falls within the scope and responsibility of the government, in the interest of national security. The data on its network actually does have life and death consequences to people. Very few other enterprises process data with such importance and consequence. So shouldn’t the government worry about its own house and worry about maintaining it; instead of trying to regulate the private industry which is not only outside of their scope of responsibility, but is also a project with so much less importance then their own. It seems insane to wish them to focus on anything other than their own networks, and data. The one exception would be for them to have a level of standards required of any business network that was allowed to connect directly to them. I am happy to report, these are relatively few. What would be the impact of government enforced cyber security in the private sector? There would be numerous impacts to the private sector if government tried to enforce cyber security regulations. Many I can name right now, and numerous I am sure would be unexpected results. †¢ The price for such regulation would ultimately fall on the average citizen to bear. †¢ The price for such regulation would drive numerous smaller companies unable to bear the cost (and also processing information not much worth hacking) out of business. †¢ The overall security posture for the private sector as a whole would be reduced- business that needed increased security then government standards would even out with businesses needing very little security carrying all kinds of security they don’t need. †¢ The rights of a business and the people to use their own judgment to decide the amount of security needed on their enterprises is once again diminished, and compromised, as well as them to suffer the consequences of misjudgments nullified. Building dependency on the government for critical thinking and analytical skills as well as basic survival skills is continued. †¢ A flourishing and profitable black market for â€Å"non-regulated† internet feeds is created. †¢ The integrity of the biased lean of the information being â€Å"regulated† through to the general population is immediately under question; resulting in further distrust of the regulating entity†¦ie government. †¢ Overall to both the businesses being regulated and the businesses that produce technology instruments and devices the impact would be negative. Should private industry have the responsibility to protect national security? Private industry has a duty to protect national security when it’s a situation that is a direct action to do so. For example, a company that processes government information has a duty to protect that information. A company that sells porcelain dolls has no responsibility to protect the national security. Just as they would not load up their employees with camouflage and weapons and send them out to a base to somewhere to â€Å"assist† the troops for a day every week, they don’t have a duty or responsibility to practice cyber security out on the internet like some kind of mercenary. It is good business sense for them to practice some level of cyber security that is appropriate to the sensitivity and value of the data they process but that is an act of self interest; and a show of good business intelligence. Not only does private industry not have a responsibility to protect the national interest by practicing cyber security, but once again should protect their own interests and leave the national interest to the appropriate experts. Only companies that process government information, or connect to government systems should be attempting to apply cyber security in the name of national interest. Those are the only people who have that duty and the only people properly schooled in the expertise to do so, and should have an interest to. Any other business or entity should remain concerned with their own business interests, or be brought under suspect for spying or espionage; they have no business being concerned with the national defense and should stay out of it. What is the visual meaning of this image? As has been already mentioned, this image has the potential to evoke contradictory visual meaning, depending on what one sees and on whether one solely sees rather than reads into the image. The implicational qualities of images alone create an array of possibilities as to how an image will be read and just what the observer will see both at the beginning and during the observation of an image. That is to say that what one may see or feel or notice, and how one will accept an image when first viewed may not necessarily be, and is usually not the same as that after observing and examining an image for some time. Images are different from texts of actual language, and this cause s one to approach an image with uncertainty; ‘The Power of One’ does not tell one how to feel or what exactly it is – there is no actual language. And so, one must decipher the unwritten yet strongly visible language portrayed. This is where the previously mentioned conflicts become apparent. Indeed, it is quite simply an image of a woman, but is she defying the soldiers or protecting her land? The expression on her face is pained, perhaps she is trying to simply protect her land†¦or it could be determination and anger, perhaps she is defying the soldiers, fighting them. But let us look at the image as a whole, for there is a great deal more language contained in other elements which will allow one to understand perhaps on a deeper level the woman and the purpose of her presence. We can see the language of the soldiers – the clothes they wear are black; a menacing colour of death; they are all male. The woman wears household clothes; she is a woman

In the year 2008, 85% of the power that we are using was nonrenewable energy, which means that someday, these energies will be gone. However, right now, there are people who have started using renewable energy such as solar energy. There are more than 7 billion people in the world right now and it will keep rising while the energy resources are depleting. Even though there are many energies that are renewable, the renewable energies are harder to make use of, which is one of the reasons why not many people use them. Also, they require some advanced technology. If we don’t find something else to replace oil, coal and natural gas, we won’t have the energy to use in the future. One of the forms of the renewable energy is solar energy. Solar energy uses energy from sunlight to create energy for our home. Sunlight is a clean, renewable resource. There are many ways to get energy from sunlight, such as the photovoltaic (PV) panels, converting sunlight into electricity and solar electricity, using the sun’s heat to produce electricity. Solar cells, or the photovoltaic panels, convert sunlight directly into electricity. We can often find solar cells in calculators and watches. Since solar cells are made up of semiconducting materials, materials whose conductivity will increase with temperature, sunlight will lose their electrons, allowing the electrons to flow through semiconducting materials to produce electricity when sunlight is absorbed. Solar electricity is separated into three kinds: parabolic-trough, dish/engine, and power tower. Parabolic-trough concentrates the sunlight through mirrors. The mirror will be tilted towards the sun, heating the oil that is flowing in the pipe inside the panel. Heated oil will then be used to boil water to produce electricity. The dish/engine is a dish-shaped mirror that will collect heat from sunlight and transfer it to the fluid within the engine. The heat would cause the fluid to expand and produce mechanical power. A power tower system uses a large field of mirrors to concentrate sunlight onto the top of a tower. This heat will melt salt that flows through the receiver and the salts heat will be used to generate electricity through a conventional steam generator. With different kinds of solar panel, the price varies in the range from $5,000 to $30,000, depending on the effectiveness and the amount of energy you use. Even though the solar panels are expensive, many people still use them since they think that solar energy is energy-efficient and green. One of the advantages solar energy has is being renewable. As long as there are living things on this planet, there will always be solar energy since we get solar energy from sunlight. Even though sunlight is not present at night, the solar energy could still be stored by charging the batteries during the day and be used at night. We could then get more sunlight on the next day. Moreover, solar energy creates absolutely no pollution or noise, unlike other machines. It doesn’t damage the environment by emitting greenhouse gases or polluting water, air or land. By using this source of energy, the air will be cleaner and it helps stop the global warming. Other than this, in the long term, the solar energy is much cheaper than the energy resources we are using now. Even though it is expensive, initially the maintenance requirement is very small and the service life is around 30 years. The main disadvantage of solar energy is that it is extremely expensive. This is mostly why nowadays, not many people use solar energy. The price is unaffordable. Furthermore, since our world is polluted, the rain or the clouds could block sunlight from getting to the panels, making it ineffective. With a cloudy climate, the panels will be able to produce sunlight at a slower rate and may require more panels to generate enough electricity for your house, which will require more money. Even though using solar energy in houses might not require huge amount of area, big buildings do. To use the solar panels to their maximum ability, they need to be in the sun. With bigger buildings, you will need many more panels and to get them to work to their maximum ability, you will need a huge amount of area for the panels to be in the sunlight. Even though solar energy has some disadvantages, the advantages still overweight the disadvantages since energies are running out and this solar energy is everywhere. If we can get all of the energy that was sent to this planet, we could light the entire planet for one year within an hour. But the problem with this is we cant. If we can find a way to harvest this energy, we can have as much electricity as we want until the end of the human generation. Right now, there are many renewable energies that scientists have found but they are not yet the best way to solve the energy crisis. Therefore, scientists are still searching for new forms of energy. Dark energy is another form of energy that is very useful to mankind. In the universe, it is composed of up to 74% dark energy. What is dark energy? Dark energy is the unexplained force that causes the acceleration of the expansion of the universe. Even though there is no evidence that the dark energy does exist, people agree that it does since they believe that the universe had a beginning, and is expanding. Other than dark energy, the underwater pressure can be another useful energy resource. Beneath the water surface, there is a potential constant source of unused hydroelectric power in the form of deep water pressure. According to Rick Dickson, he had invented a way to harvest this deep water pressure by transferring its pressure to air and then to a piston. The name of this process is called Ocean Pressure Electric Conversion. In most occasions, success of an individual has been attributed to the persons personality as well as skills and techniques amongst other many aspects like positive attitude. In reality success in a person is attributed to the personality as well as the character ethics. Thus, the assessment of the habits displayed by individuals who can be termed as highly effective in the society is considered to be an inside out approach, whereby change in a person has to begin from within then it transforms to the outside. Effective people Individuals characters are said to be a collection of a number of habits, and in that respect habits tend to have a strong impact in various aspects of our lives. In reality habits are made up of knowledge, desire as well as skills. Proactive as a habit is a unique element in a person that creates a difference between persons. Even though conditioning can have an influence on a persons life, in the actual sense individuals cannot be determined by conditioning (Covey, 1990). Some of the theories that have been presented to explain the concept of proactivity include genetic and environmental as well as physic determinism. In genetic physic, it is discussed that a persons nature is determined by the nature of DNA, and in that respect a persons personality traits are acquired from his or her grandparents. As for the physic determinism, it is discussed that the way in which a person has been brought up will influence the habits. In addition to that, the painful childhood experiences have an influence on the persons adult life. Finally, environmental determinism demonstrates that the current environmental factors have an influence on a persons behaviors (Covey, 1990). Proactivity in individuals can thus be described as that ability of individuals to carry out their activities while driven by the value proposition, which is said to be independent of the general environmental forces. Effective people in most occasions use the difficult life encounters to establish their character as well as develop their potential to deal with such difficulties in the future if they occur. In that way, such persons are able utilize their resourcefulness and ability to devise possible solutions, other than relying on other people to solve their personal problems. Therefore effective persons are those that are able to make life decisions, which have the potential of improving their personal lives. In such situations, decisions are made on the things that influence their person lives other than just acting to the general environmental forces (Covey, 1990). The second habit that highly effective people will tend to display is that the start with the end in mind. In such situations, such kind of effective people are able to establish their personal principles in terms of a mission statement, and then the mission statement is carried forward to the persons long term goals which will always be founded on the persons principles (Covey, 1990). The habit of first things first is displayed in highly effective people, whereby an individual takes valuable time carrying out activities that go in line with his or her personal mission. Effective people thus manage to make an appropriate balance between the production activities, as well as in establishing the production capacity. In order to create that balance in their lives, effective people will determine the key roles that they carry out in life, and then allocate appropriate time for each of those roles (Covey, 1990). Effective people think win, whereby they seek to do things like agreements as well as relationships in life will be mutually beneficial to their lives. In circumstances where such people are able to establish that win cannot be attained by taking a certain deal, they will accept such a situation and then establish alternative ways in which they can be able to attain success. Haleeb Foods Company Analysis Haleeb foods limited, formerly known as Chaudhry dairies was formed in 1985. It is one of the fastest growing companies since its inception. The core product of the company has always been packaged milk but it currently operates in several other food product categories. It has continued to provide high quality products to its customers and is one of the first companies In Pakistan to use tetra packs innovative packaging technology. It is principally engaged in processing and sale of toned milk, milk powder, allied dairy products and fruit juices. (Haleeb Foods Intern Report, 2012) It was founded back in 1985 with a total capacity of 80000 liters per day and has two production plants. The main production facility is at Bhai Pheru, known as the BHP (Bhai Pheru Plant). Due to its tremendous success and a high demand for its products especially Haleeb Milk the company set up another plant at Rahim Yar khan. The RYK plant is a state of the art facility. Covering an area of over 72 acres the plant it equipped with the latest technology and was a very fine project that Haleeb Foods undertook. Liquid milk was the first product produced at the company and was a huge success. There were around 20 to 25 other dairy companies operating in Pakistan at that time but Haleeb as a company was still able to stand out of the clutter. It was an incredible team of over 700 employees at the BHP and an outstanding marketing team that contributed to this success. Haleeb foods has segmented its product portfolio into multiple brands including Haleeb, Candia and Tropico. Haleeb is the flagship brand of the company. Haleeb UHT milk is available in five SKUs of Tetra pack packaging. (Irfan, 2012) Due to its strong positioning of being the thickest milk best for tea and the highest top of mind awareness in the dairy industry of Pakistan the company has been able to increase its sales and has had a significant consumer and trade penetration of the brand. It is also available in Tetra Fino packaging under the brand of Dairy queen. By strictly following the quality control measures the company was also one of the first few companies in Pakistan to get ISO certified. This had a huge impact on the perceived quality of its customers and help boost sales in its early years. The company has also been a pioneer in introducing the tetra pack Fino packaging and introducing sterilized milk in the country. The company has diversified into multiple products and a vast product line over the years. The basic product line extension includes products like Haleeb Cream, Haleeb Butter, Haleeb Asli Desi Ghee, Daizy yoghurt, Candia, Just fruit, Tropico juice, Haleeb Labban, Haleeb Funday juice, Haleeb Good day etc. The company entered into a franchise agreement with Caddilac France and launched Candia milk in 1999. Today Haleeb Foods no longer produces Candia. The company has a vast distribution network covering a number of cities across Pakistan. This is one factor that contributed positively to its success and help the company build an ever growing consumer network. In an attempt to fulfill the ever changing needs and meet the increasing demands of its customers the company has diversified its product portfolio gradually over the years. Many products like Candia milk and Skimz milk that were present in the market before are no longer available and have been replaced by new products. The company has upgraded many of its recipes and re-launched a couple of products in an attempt to better meet the needs of its target market. Some of the latest product categories at Haleeb are: UHT Milk: Haleeb was the first company that introduced UHT milk in Pakistan. The UHT milk category currently includes Haleeb milk only. Beverages: Several products are produced at the Haleeb production plant as part of the beverage category. Some well-known beverages include Just fruit, Fun milk, Tropico and Haleeb doodh. Just fruit, as the name suggests is a fruity drink produced using farm fresh fruits. It is available in a wide variety of flavors including Apple, Orange, Mango and Grapes. The company has a number of milk collection centers where raw milk is delivered by gawalas, small scale farmers and some milk providing companies. Companys profitability started to decline over the years along with the quality of its products. The Rahim Yar Khan project had a huge impact on the companys financial position and although it is a state of the art facility, its still not operational today. Haleeb rents out its tetra pack section at RYK to Nestle during the high demand season. Due to the poor management of resources and not very well managed decisions the company has incurred huge losses for the last few years. In Nov 2011 Haleeb foods ltd was acquired by a large giant in the market namely Mega and Forbes. They appointed a new chief executive officer, Mr. Faisal Imran Hussain Malik who is a highly qualified and a very competent person. Since November 2011 Haleeb is in the process of restructuring. The company which once had over 750 employees currently has cut it down to only 450 employees. A lot of firing and termination of incompetent people (in the managements view) took place. The company is highly unstable since then but is gradually moving towards stability. The new management has a very unique and a different management style from what the employees at Haleeb were used to. This is one reason that led to a highly demotivated workforce at the company. The employees and the top management are having issues in adjusting with each. The large number of terminations has created high levels of job insecurity, employees no longer feel that they belong to the organization and on the other hand the management is highly dissatisfied by the performance they deliver at work. Employees who are competent and have hands on experience in various fields are resigning, thus fueling the workforce problem. As a result of this, management has started to hire new employees at a very fast pace. Management trainee programs are formally introduced into the company in an attempt to inject new blood into the organization. Instead of making things better this new hiring is worsening the situation. Older employees show resistance towards the newer ones while the management is training them and investing huge sums of money in their development. The element of job insecurity is also worsening. Nestle is a well reputed and a well performing FMCG company in Pakistan. It is the market leader and has highest market share in the industry. The companys overall financial performance is satisfactory and compared to Engro it is much superior. As we infer from its profitability ratios that the company is profitable. Its gross margin, net profit margin and the operating profit margin have shown a slight decline from 2009-2010. But is ROA has increase to 11.02% in 2010 and ROE increased to 16.7%.Which is a good indicator of the companys health. It shows that the companys assets are paying off well. When compared to Engro it is can be seen that the gross profit margin ratio is higher (23.27%) as compared to the ICIs 19.1% in 2010. The net profit margin for Engro however is -3.4% as compared to the ICIs + 6.9%. This shows that Engro has high operating expenses like the administrative expense etc. in this regard Nestle performance is superior. The comparison of the liquidity ratios, more precisely the current ratios show that Nestle has a ratio of 2.17 whereas Engro has a ratio of 0.9. Nestle is in a better position in terms of it liquidity. The liquidity implications for the firm were positive as shown by the increase in the working capital from 82.19 million in 2009 to RS 320.6 million in The inventory turnover ratio shows that Nestle has an inventory turnover almost double the amount of Engros. Engros inventory turnover is 3.39 whereas for Nestle has an inventory turnover of 6.67. The higher the inventory turnover the better it is for the company, so Nestle is better off. From the efficiency ratios at Nestle, we can infer that Nestle, Engro and all other companies in the industry are facing problems. The hiking oil prices and gas and energy crisis are all increasing the companys expenses. Haleeb Foods Where Nestle is the market leader, Haleeb was established in 1986 and its first product was Haleeb milk. Since then, it has continued to provide quality products to its consumers with product and packaging innovations. The overall analysis of the firms financial statements shows that the company is not doing well. Compared to the industry leaders like Nestle and Engro, Haleeb is not that large a company. A deeper look into the company shows that its profitability has decreased from 2009-2011. Its net profit margin has reduced to 4.83% in 2011 from 7.19% in 2009. Although it is not a good indicator for the company, it still higher than the Engros -1.9%. This shows that compared to the industry averages Engro is doing poor in terms of its profitability. In terms of the gross profit margins Engro has superior results compared to both Nestle and Haleeb. From this we could conclude that the cost of goods Engros liquidity position is weak as compared to its competitors. Its current ratio of 0.9 in 2010 is even lower than the Haleebs 1.1. Turnover ratios on the other hand shows that Engro is doing better than the Haleeb foods, it has a higher inventory turnover of 3.3 is higher than the Haleebs 2.8 in 2010. This shows that Engro is selling off its inventory faster as compared to Haleeb foods. Overall, from the above analysis we can conclude that Engro is better than the competitors in terms of its activity ratios. It is effectively managing its turnover whereas the ultimate measure of a companys success, the profitability ratios reveal that Haleeb is doing poor. It seriously needs to improve its profitability in the coming years. Engro The overall profitability of the company is decreasing its return on shareholders equity is also showing a negative trend of -17.19% in 2011 and so is the return on common equity.. This decrease is mainly due to the increase in the companys expenses primarily its administrative expenses and the taxes. The cost of goods manufactured, have also increased for Engro. Looking at Engros gross profit margins over the last three years we can conclude that the companys gross profit was stable at around 23% in the financial years 2009 and 2010. However ion 2011, due to a rise in expenses the companys gross profit has slightly decreased to 20.8%. Engros gross profit is showing a fluctuating trend. It was around 2.8% in 2009 then rose to 5.1% in 2010 and then again fell to 4.1% in 2011. These changing trends and fluctuations can be attributed to the changing market environments and the highly variable national and global economic trends. Engros net profitability ratios show a large amount of uncertainty as it was 0.7% in 2009, and then fell further to negative 3.4% in 2010. However, in 2011 it can be seen that although the companys net profit margin is negative it is still showing a positive trend towards betterment. Return on asset ratio is ratio is showing a declining trend which is not a healthy sign. Current ratio shows the relationship between the current assets and the current liabilities of the company over the last s increase in assets is accompanied by an increase in the liabilities. This is why the current ratio for Engro did not improve. It has been stable around 0.9% over the last few years. Quick ratio at Engro is showing a slow increasing trend which enables us to conclude that the current assets of the company is increasing. For Engro, their debt to equity ratio decreased tremendously to almost o% in 2010 but unfortunately the company could not maintain it and it rose to 6.3% in 2011. Engro should effectively manage its debt to equity ratio as an increasing trend in this ratio is not a very good sign of the health of the company. It shows that the company is focusing more on debt financing as opposed to equity financing and this will affect the companys image in the eyes of the shareholders. The Economic and Political Motives of the American Constitution vs. the Articles of Confederation Introduction The Constitution of the United States of America is often revered and thought of as the basis for all democracies around the world. However, when it is used as an example of the perfect democracy, the facts and history behind its creation are often left out. While it is a fascinating document, it is not the pinnacle of perfection that we often hold it up to be. It had a stumbling start, full of problems and arguments, instead of the immaculate conception that is often described. Its beginnings were much humbler, and they started with the Articles of Confederation. It is somewhat strange that the American people know so little of the fundamental nature of their system of government. Their acquaintance with it extends only to its outward form and rarely includes a knowledge of the political philosophy upon which it rests. The sources of information upon which the average man relies do not furnish the data for a correct understanding of the Constitution. (Smith, Allen, 1965: 30) What I propose to show is that the Constitution of the United States is not necessarily the best form of government for the United States, but that a reworking of the Articles of Confederation would have been sufficient. The motives I would like to call into question are those of the Framers of the Constitution, but also those of the Framers of the Articles of Confederation. The Articles of Confederation are often historically overlooked, but they play a major role in the creation of the Constitution.
